General Terms and Conditions

§ 1 Scope & Defence Clause

1.1. The following General Terms and Conditions (GTC) govern the customer relationship established between commercial and/or private users and amurcamper.com with regard to all services offered.

1.2. The current version of the Terms and Conditions, as available on the websites, applies. Amurcamper reserves the right to adapt its Terms and Conditions for future transactions at any time.

1.3. Any deviating terms and conditions of the customer do not apply. They do not apply even if they are not expressly contradicted.

§ 2 Conclusion of the contract/contractual obligation

2.1. The presentation of goods in the online shop, on advertising media, or at exhibitions does not constitute a binding offer by Amurcamper.com to conclude a purchase contract. The customer is hereby merely invited to submit an offer by placing an order.

2.2. By placing an order or an order of any kind, the customer makes a binding offer aimed at concluding a work or purchase contract. By submitting the order, the customer acknowledges these terms and conditions as the sole authoritative basis for the legal relationship with us.

2.3. The contract is concluded upon confirmation or an express declaration of acceptance by us.

2.4.Offers are generally valid for 14 days, unless a different period is expressly specified in writing.

2.5.For rental offers of any kind, we reserve the right to sell or rent out the offered vehicles until the contract is concluded.

2.6.Amurcamper is entitled to pass on price adjustments from its suppliers even after submission of an offer or during the work contract.

§ 3 Retention of title

3.1. The delivered goods remain the property of the provider until full payment has been made.

§ 4 Due Date

4.1. Unless otherwise agreed, payment of the purchase price or the deposit for private customers is due upon or before conclusion of the contract.

§ 5 Warranty

5.1. The customer's warranty rights are governed by the general statutory provisions, unless otherwise stated below.
For claims for damages by the customer against the provider, the provisions in § 6 of this SDC.

5.2. The limitation period for customer warranty claims is 2 years for newly manufactured items for private individuals and 1 year for used items. Excluded from the warranty are consumables such as brakes, batteries, fuses, etc.
For businesses, the limitation period is 1 year.
The above shortening of the limitation period does not apply to claims for damages due to injury to life, limb, or health, or to claims for damages due to a breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract; e.g., amurcamper must hand over the item to the customer free of material and legal defects and transfer ownership of it. The above shortening of the limitation periods also does not apply to claims for damages based on an intentional or grossly negligent breach of duty on our part.

§ 6 Disclaimer

6.1. Customer claims for damages against Amurcamper are excluded, especially if the damage is caused by a defect in the purchased item.
Regardless of any fault on the part of the seller, any liability of the seller for fraudulent concealment of the defect, for the assumption of a guarantee or a procurement risk, and under the Product Liability Act remains unaffected.
The seller is not liable for damages resulting from improper use of the products or for damages that are the responsibility of the manufacturer.

6.2. The above exclusion of liability also applies to the legal representatives and vicarious agents of Amurcamper, provided the customer asserts claims against them.

6.3. Provisions of the Product Liability Act remain unaffected.

6.4. The tenant or interested party is solely responsible for any injuries to persons or property that occur during use of the property.

§ 7Data treatment, data protection, data security

7.1.Amurcamper undertakes to comply with the relevant data protection regulations and not to disclose customer data to third parties. The customer agrees that his or her personal data may be collected, processed, and used by us within the framework specified by the purpose of the customer contract.

7.2. The customer provides his or her consent by submitting his or her data or by any other form of written registration or contact.

7.3. The customer further agrees that the data related to his or her order may be used for the purpose of establishing contact and for the purposes of product range and product development.p>

7.4.The design of the site, the graphics, and the collection of contributions are protected by copyright. These pages may not be reproduced, modified, or distributed for private or commercial use, nor may they be used for public reproduction without our written permission. Under no circumstances will we assume liability for damages resulting from the use of the information retrieved.

§ 8 Responsibility for Content

8.1. Amurcamper displays product information based, among other things, on information provided by the manufacturers.
Amurcamper must rely on the correct content of the data and therefore cannot guarantee or assume liability for the accuracy of this data. In this context, we point out that we have no influence on the design and content of linked pages.
We therefore expressly distance ourselves from the content of all linked pages.

§ 9 Prohibition of Assignment and Pledging

9.1. The assignment or pledging of claims or rights to which the customer is entitled against us is excluded without the consent of the provider, unless the customer proves a legitimate interest in the assignment or pledging.

§ 10 Choice of Law & Jurisdiction

10.1. All legal relationships between Tiersch construction d.o.o., to which the "Amurcamper.com" website belongs, and the customer are governed exclusively by Montenegrin law. The place of jurisdiction for disputes arising from this contract is Podgorica, Montenegro.

§ 11 Severability Clause

11.1. Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
